In Costa Rica boundary validation of a property is a fundamental process in any transaction. This due diligence process, carried out by a surveyor, involves verifying and confirming the physical limits of a property to ensure they align with existing legal documentation.
During the boundary validation process, it’s important to consider potential differences or conflicts. In the event of discrepancies between the property boundaries and those on the cadastral plan, everything should be indicated as a result of the due diligence.
Depending on the impact of the differences and following the lawyer’s recommendation, the buyer may renegotiate with the seller (if the study indicated a smaller area); and/or rectify the cadastral map.
